 The Council is contesting the          
 Government's refusal, firstly to       
 designate the Island as a Tier 2       
 Assisted Area and secondly to put      
 forward to the European Commission the 
 Island as an Objective 2 area under EU 
 Structural Funds. Leave to apply for a 
 Judicial Review was granted in the High
 Court in London on 2 November and two  
 days were set aside on 14/15 December  
 to hear the case.                      
 A key element of the Island's case     
 hinges around the interpretation of    
 Article 158 of the Amsterdam Treaty,   
 which states that the EU should aim at 
 reducing the backwardness of islands.
